These Terms of Service govern your use of the Histories and Castles website and the purchase of any products, including physical goods and digital educational programmes.

By using this website and purchasing from us, you agree to these Terms.

Histories and Castles is a UK-based business providing:

  • Digital educational content delivered online

SECTION A: DIGITAL PRODUCTS 

2. Digital Products and Delivery

All courses and educational materials, including Study Guides, Investigated Histories and posters are delivered digitally.

Upon purchase:

  • Payment is processed via Shopify
  • You will receive confirmation by email

No physical materials are supplied unless explicitly stated.

3. Contract Formation

A contract is formed when:

  • payment has been successfully processed, and
  • you receive confirmation of your order

We reserve the right to refuse or cancel any order.

4. Immediate Access and Waiver of Cancellation Rights

By purchasing digital content:

  • You expressly request immediate access to the content
  • You acknowledge that your statutory 14-day cancellation right is lost once access begins

Access is deemed to begin when:

  • login credentials are issued, or
  • the material is made available to you

5. Refund Policy (Digital Content)

Due to the nature of digital content:

  • Once access has been granted, the product is considered used

Refunds will not be provided except where:

  • the digital content is faulty, or
  • the content is not as described, or
  • we are legally required to provide a remedy

No refund will be issued where:

  • login has occurred, or
  • any course content has been accessed

This does not affect your statutory rights under the Consumer Rights Act 2015.

6. Licence and Intellectual Property

Upon purchase, you are granted:

  • a single-user, non-transferable, non-commercial licence

You must not:

  • share login details with any third party
  • allow multiple users to access the course via one account
  • copy, download, reproduce, or distribute any content
  • resell or republish materials

All content remains the intellectual property of Histories and Castles.

We reserve the right to:

  • monitor usage patterns
  • suspend or terminate accounts where unauthorised use is suspected

7. Account Security

You are responsible for:

  • maintaining the confidentiality of your login credentials
  • all activity carried out under your account

Account sharing is strictly prohibited.

8. Access Duration

You are granted lifetime access to purchased courses.

We reserve the right to:

  • update, modify, or remove content
  • change the delivery platform or structure

where reasonably necessary for operational or technical reasons.

9. Educational Purpose and Certification

All courses are provided for educational and informational purposes only.

Any certificate issued:

  • confirms course completion only
  • does not represent a formal or accredited qualification
  • has no vocational or regulatory status

10. No Guarantee of Results

We do not guarantee:

  • specific learning outcomes
  • personal, academic, or professional results

Outcomes depend on individual effort and application.

11. Technical Availability

We aim to provide continuous access.

However, we are not liable for interruptions caused by:

  • third-party platforms (including Shopify or delivery apps)
  • hosting or server failures
  • internet or technical issues outside our control

SECTION B: PHYSICAL PRODUCTS

12. Orders and Delivery

Physical goods will be delivered to the address provided at checkout.

Estimated delivery times are provided for guidance only and are not guaranteed.

13. Pricing and Payment

All prices are listed in GBP unless stated otherwise.

Payment must be received in full before dispatch.

14. Right to Cancel (Physical Goods)

You have the right to cancel your order within 14 days of receiving your goods.

To exercise this right, you must notify us in writing within this period.

15. Returns (Physical Goods)

To be eligible for a return:

  • items must be unused
  • items must be in their original condition and packaging
  • items must not be handled beyond what is necessary to inspect them

Returns must be initiated within 14 days of delivery.

16. Refunds (Physical Goods)

Refunds will be processed after:

  • returned goods are received, and
  • items are inspected

We reserve the right to reduce refunds where goods show signs of use beyond reasonable inspection.

Return shipping costs are the responsibility of the customer unless the item is faulty.

17. Faulty or Damaged Goods

If an item is faulty, damaged or not as described, please tell us as soon as you notice, including photographs where possible. Under the Consumer Rights Act 2015 you can reject faulty goods for a full refund within 30 days of delivery, and after that we will repair, replace or refund within six months of delivery. This does not affect your statutory rights.

GENERAL TERMS

All website content, including text, images, branding, and design, remains the property of Histories and Castles.

Unauthorised use is prohibited.

19. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect or consequential losses
  • Our total liability is limited to the amount paid for the product

Nothing in these Terms excludes liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation

We may rely on third-party providers to deliver services.

We are not responsible for:

  • their performance
